TERMS AND CONDITIONS
1. Definitions
1.1 ‘Conditions’ means these terms and conditions.
1.2 The ‘seller’ is Dann Antiques Limited. Who’s registered office is at Unit 1, Avonside Business Park, New Broughton Road, Melksham, Wiltshire, SN12 8BS, registered in England and Wales No. 2234985.
1.3 ‘Goods’ means a product or goods displayed for sale by the seller, either in the showroom or on the website or at any other temporary location, for whatever reason.
1.4 ‘You’ means the person, persons or company, visiting the premises or using the website with the intention of buying goods.
1.5 No contract exists between you and the seller for the sale of any goods until the seller has received and accepted your order and any deposits, as required.
1.6 The seller may change these terms of sale without notice to you in relation to future sales.
2 Description and price of goods
2.1 The description and price of the goods you order will be as shown on the seller’s website, or as seen and agreed in the showroom.
3 Payment and delivery.
3.1 The goods are subject to availability. Lead times given for bespoke items are for guidance only as there are many influences outside of the seller’s control that may determine the actual delivery date.
3.2 Delivery of the goods will not normally be arranged before full payment has been received by the seller.
3.3 The goods will remain the property of the seller until full payment has been received.
4 Cancellation, Returns and Refunds.
4.1 If the goods purchased, except bespoke items, are not to your satisfaction, the goods must be returned to the seller within 14 days of the original purchase date. It is your responsibility to pay return shipping costs. Furthermore, you must notify the seller within 7 days of the original purchase date. No refunds will be given after 7 days. Refunds will be net of the outward packing and shipping costs.
4.2 The seller reserves the right to recover all costs as to the delivery and collection of the goods to be returned.
4.3 Bespoke goods cannot be returned once a contract has been entered into and no refunds can be made.
5 Installation, Fitting and Warranty
5.1 All goods with moving parts are fitted with operational hazard warnings, where appropriate and these must be adhered to.
5.2 Where electrical appliances of any kind are being fitted to the goods supplied, the work must be carried out by a suitably qualified professional.
5.3 Any goods delivered and are installed/fitted with mechanical moving parts are warranted for 12 calendar months. This warranty does not affect your statutory rights as a consumer.
5.4 This warranty does not apply to any defect in the goods arising from; fair wear and tear, wilful damage, accident, negligence by you or any third party, use otherwise than as recommended by the seller, failure to follow the seller’s instructions, or any alteration or repair carried out without the sellers express approval.
5.5 If the goods supplied to you develop a defect while under warranty or you have any other complaint about the goods you should notify the seller in writing via the e-mail address or fax number shown below, as soon as possible, but in any event within 7 days of the date you discovered or ought to have discovered the damage, defect or complaint.
6 Limitation of Liability.
6.1 The seller’s total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation restitution, or otherwise, arising in connection with the performance or contemplated performance of this agreement shall be limited to the price paid for the goods.
6.2 If you are a business customer the seller shall not be liable to you for any indirect or consequential loss or damage (whether for loss of profit, loss of business, depletion of goodwill or otherwise), costs, expenses or other claims for consequential compensation whatsoever (however caused) which arise out of or in connection with this agreement.
7 Data Protection and Privacy Policy.
7.1 The seller will not knowingly disclose your information to third parties.
7.2 The seller will take all reasonable precautions to keep the details of your order and payment secure. But unless the seller is negligent, the seller will not be liable for unauthorised access to information supplied by you.
8 Applicable Law.
8.1 These terms and conditions of sale and the supply of the goods will be subject to English law and the English courts will have jurisdiction in respect of any disputes arising from the contract.
